Questo articolo corrisponde al principio generale di diritto che figura in tutte le costituzioni europee ed è stato sancito dalla Corte come uno dei principi fondamentali del diritto comunitario (sentenza del 13 novembre 1984, Racke, causa 283/83, Racc. 1984, pag. 3791, sentenza del 17 aprile 1997, causa C-15/95, EARL, Racc. 1997, pag. I-1961 e sentenza del 13 aprile 2000, causa C-292/97, Karlsson, Racc. 2000, pag. 2737).
