Artikel 15 - Fritt yrkesval och rätt att arbeta

1. Var och en har rätt att arbeta och utöva ett fritt valt eller accepterat yrke.
2. Varje unionsmedborgare har rätt att söka arbete, arbeta, etablera sig samt tillhandahålla tjänster i varje medlemsstat.
3. De tredjelandsmedborgare som har tillstånd att arbeta på medlemsstaternas territorium har rätt till samma arbetsvillkor som unionsmedborgarna.

      Rätten till fritt yrkesval, som slås fast i artikel 15.1, erkänns i domstolens rättspraxis (se bl.a. domarna av den 14 maj 1974, mål 4/73, Nold, Rec. 1974, s. 491, punkterna 12–14; den 13 december 1979, mål 44/79, Hauer, Rec. 1979, s. 3727; den 8 oktober 1986, mål 234/85, Keller, Rec. 1986, 2897, punkt 8).
      Till grund för denna punkt ligger även artikel 1.2 i europeiska sociala stadgan, som undertecknades den 18 oktober 1961 och har ratificerats av samtliga medlemsstater, samt punkt 4 i gemenskapsstadgan om arbetstagares grundläggande sociala rättigheter av den 9 december 1989. Uttrycket `arbetsvillkor` bör tolkas i enlighet med artikel 156 i fördraget om Europeiska unionens funktionssätt.
      I punkt 2 återges de tre friheter som garanteras i artiklarna 26 och 45, 49 och 56 i fördraget om Europeiska unionens funktionssätt, nämligen fri rörlighet för arbetstagare, etableringsfrihet samt frihet att tillhandahålla tjänster.
      Punkt 3 har grundats på artikel 153.1 g i fördraget om Europeiska unionens funktionssätt och artikel 19.4 i europeiska sociala stadgan, som undertecknades den 18 oktober 1961 och har ratificerats av samtliga medlemsstater. Artikel 52.2 i stadgan ska följaktligen tillämpas. Frågan om anställning av sjömän som är tredjelandsmedborgare i besättningarna på fartyg som för en unionsmedlemsstats flagg regleras i unionsrätten och nationell lagstiftning och praxis.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

The conditions and procedure for the exercise of the right to strike are provided by law.
      The procedure for resolution of labour disputes is provided by law.

As an exception to the aforesaid provisions of this Article a law may provide, if it is in the public interest, that certain enterprises of the nature of an essential public service or relating to the exploitation of sources of energy or other natural resources shall be carried out exclusively by the Republic or a municipal corporation or by a public corporate body created for the purpose by such law and administered under the control of the Republic, and having a capital which may be derived from public and private funds or from either such source only:
      Provided that where such enterprise has been carried out by any person, other than a municipal corporation or a public corporate body, the installations used for such enterprise shall, at the request of such person, be acquired on payment of a just price, by the Republic or such municipal corporation or such public corporate body, as the case may be.
