Artikel 49 - Legaliteitsbeginsel en evenredigheidsbeginsel inzake delicten en straffen

1. Niemand mag worden veroordeeld wegens een handelen of nalaten dat geen strafbaar feit naar nationaal of internationaal recht uitmaakte ten tijde van het handelen of nalaten. Evenmin mag een zwaardere straf worden opgelegd dan die, die ten tijde van het begaan van het strafbare feit van toepassing was. Indien de wet na het begaan van het strafbare feit in een lichtere straf voorziet, is die van toepassing. 2. Dit artikel staat niet de berechting en bestraffing in de weg van iemand die schuldig is aan een handelen of nalaten dat ten tijde van het handelen of nalaten een misdrijf was volgens de door de volkerengemeenschap erkende algemene beginselen. 3. De zwaarte van de straf mag niet onevenredig zijn aan het strafbare feit.

      In dit artikel wordt de klassieke regel van de niet-terugwerkende kracht van wetten en sancties op strafrechtelijk gebied overgenomen. De regel van de terugwerkende kracht van de mildere strafwet, die in tal van lidstaten bestaat en die vervat is in artikel 15 van het Verdrag inzake burgerrechten en politieke rechten, is hieraan toegevoegd.

      Artikel 7 van het EVRM luidt als volgt:

      `1. Niemand mag worden veroordeeld wegens een handelen of nalaten, dat geen strafbaar feit naar nationaal of internationaal recht uitmaakte ten tijde dat het handelen of nalaten geschiedde. Evenmin mag een zwaardere straf worden opgelegd dan die, die ten tijde van het begaan van het strafbare feit van toepassing was.

      2. Dit artikel staat niet in de weg aan de berechting en bestraffing van iemand, die schuldig is aan een handelen of nalaten, dat ten tijde van het handelen of nalaten, een misdrijf was overeenkomstig de algemene rechtsbeginselen die door de beschaafde volken worden erkend.`.

      In lid 2 is alleen het woord `beschaafde` geschrapt, waardoor de inhoud van dit lid, dat vooral betrekking heeft op misdrijven tegen de menselijkheid, niet verandert. Overeenkomstig artikel 52, lid 3, heeft het gewaarborgde recht dus dezelfde inhoud en reikwijdte als het door het EVRM gewaarborgde recht.

      Lid 3 behelst het algemene beginsel van de evenredigheid van strafbare feiten en straffen, dat is vastgelegd in de constitutionele tradities die de lidstaten gemeen hebben en in de jurisprudentie van het Hof van Justitie van de Europese Gemeenschappen.

      Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.
