Žmogaus orumas yra neliečiamas. Jį reikia gerbti ir saugoti.

      Žmogaus orumas savaime yra pagrindinė teisė, tačiau jis taip pat yra tikrasis pagrindinių teisių pagrindas. Žmogaus orumas buvo įtvirtintas 1948 m. Visuotinės žmogaus teisių deklaracijos preambulėje: `Kadangi visų žmonių giminės narių prigimtinio orumo ir lygių bei neatimamų teisių pripažinimas yra laisvės, teisingumo ir taikos pasaulyje pagrindas.` 2001 m. spalio 9 d. sprendime Nyderlandai prieš Europos Parlamentą ir Tarybą, C-377/98, Rink. 2001, p. I–7079, 70–77 punktuose Teisingumo Teismas patvirtino, kad pagrindinė teisė į žmogaus orumą yra Sąjungos teisės dalis.
      Tai reiškia, kad nė viena iš šioje Chartijoje nustatytų teisių negali būti naudojama kito žmogaus orumui pažeisti ir kad žmogaus orumas yra Chartijoje nustatytų teisių esminė dalis. Todėl jis turi būti gerbiamas, net kai teisė yra apribota.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Šie išaiškinimai buvo pirmą kartą parengti prižiūrint Europos Sąjungos pagrindinių teisių chartiją rengusio Konvento prezidiumui. Jie buvo atnaujinti Europos konvento prezidiumo atsakomybe, atsižvelgiant į Konvento įvestas Chartijos teksto projekto pataisas (ypač 51 ir 52 straipsnių) ir kitus Sąjungos teisės pakeitimus. Nors išaiškinimai neturi teisinės galios, jie yra svarbi Chartijos nuostatoms išaiškinti skirta aiškinimo priemonė.

      1° het recht op arbeid en op de vrije keuze van beroepsarbeid in het raam van een algemeen werkgelegenheidsbeleid dat onder meer gericht is op het waarborgen van een zo hoog en stabiel mogelijk werkgelegenheidspeil, het recht op billijke arbeidsvoorwaarden en een billijke beloning, alsmede het recht op informatie, overleg en collectief onderhandelen;
      2° het recht op sociale zekerheid, bescherming van de gezondheid en sociale, geneeskundige en juridische bijstand;
      3° het recht op een behoorlijke huisvesting;
      4° het recht op de bescherming van een gezond leefmilieu;
      5° het recht op culturele en maatschappelijke ontplooiing;
      6° het recht op gezinsbijslagen.
