Artículo 45 - Libertad de circulación y de residencia

1. Todo ciudadano de la Unión tiene derecho a circular y residir libremente en el territorio de los Estados miembros. 2. Podrá concederse libertad de circulación y de residencia, de conformidad con lo dispuesto en los Tratados, a los nacionales de terceros países que residan legalmente en el territorio de un Estado miembro.

      El derecho garantizado en el apartado 1 es el que garantiza la letra a) del apartado 2 del artículo 20 del Tratado de Funcionamiento de la Unión Europea (véase asimismo la base jurídica en el artículo 21 y la sentencia del Tribunal de Justicia de 17 de septiembre de 2002, asunto C-413/99, Baumbast, Rec. 2002, p. 709). De conformidad con lo dispuesto en el apartado 2 del artículo 52, se aplicará en las condiciones y dentro de los límites establecidos en los Tratados.

      El apartado 2 recuerda la competencia otorgada a la Unión por los artículos 77, 78 y 79 del Tratado de Funcionamiento de la Unión Europea. Por consiguiente, la concesión de este derecho depende del ejercicio de esta competencia por las instituciones.

      The right to movement within the territory of the Republic of Croatia and the right to depart may be exceptionally be curtailed by law, if necessary to protect the legal order, or the health, rights and liberties of others.

      Citizens of the Republic of Croatia shall be European Union citizens and shall enjoy the rights
      guaranteed by the European Union acquis communautaire, and in particular:
      – freedom of movement and residence in the territory of all Member States,

      Svatko tko se zakonito nalazi na teritoriju Republike Hrvatske ima pravo slobodno se kretati i birati boravište.
      Svaki državljanin Republike Hrvatske ima pravo u bilo koje doba napustiti teritorij države i naseliti se trajno ili privremeno u inozemstvu i bilo kada se vratiti u domovinu.
      Pravo kretanja na teritoriju Republike Hrvatske, pravo ulaska u nju i izlaska iz nje može se iznimno ograničiti zakonom, ako je to nužno radi zaštite pravnog poretka, ili zdravlja, prava i sloboda drugih.

      Državljani Republike Hrvatske su građani Europske unije i uživaju prava koja im jamči pravna stečevina Europske unije, a osobito:
      – slobodu kretanja i nastanjivanja na području svih država članica,
