Artikel 21 - Icke-diskriminering

1. All diskriminering på grund av bland annat kön, ras, hudfärg, etniskt eller socialt ursprung, genetiska särdrag, språk, religion eller övertygelse, politisk eller annan åskådning, tillhörighet till nationell minoritet, förmögenhet, börd, funktionshinder, ålder eller sexuell läggning ska vara förbjuden.
2. Inom tillämpningsområdet för fördragen, och utan att det påverkar tillämpningen av någon särskild bestämmelse i dem, ska all diskriminering på grund av nationalitet vara förbjuden.

      I punkt 1 har inspiration hämtats från artikel 13 i EG-fördraget, som nu har ersatts av artikel 19 i fördraget om Europeiska unionens funktionssätt, artikel 14 i Europakonventionen samt artikel 11 i konventionen om mänskliga rättigheter och biomedicin när det gäller det genetiska arvet. I den mån den överensstämmer med artikel 14 i Europakonventionen ska den tillämpas i enlighet med denna.
      Det föreligger ingen motsättning eller oförenlighet mellan punkt 1 och artikel 19 i fördraget om Europeiska unionens funktionssätt, vilken har en annan räckvidd och ett annat syfte; artikel 19 ger unionen befogenhet att anta lagstiftningsakter, inbegripet harmonisering av medlemsstaternas lagar och författningar, i syfte att bekämpa vissa former av diskriminering, som utförligt räknas upp i den artikeln. Sådan lagstiftning får omfatta all verksamhet av medlemsstaternas myndigheter (samt förbindelserna mellan enskilda individer) på alla områden inom gränserna för unionens befogenheter. Bestämmelsen i artikel 21.1 ovan däremot skapar inte någon befogenhet att anta antidiskrimineringslagar på dessa områden av medlemsstatens eller enskildas verksamhet, och inte heller innehåller den ett övergripande förbud mot diskriminering på sådana vittomfattande områden. I stället tar den endast upp diskriminering från unionens egna institutioner och organ vid utövandet av befogenheter som de tilldelats i enlighet med fördragen samt diskriminering från medlemsstaterna endast när dessa tillämpar unionsrätten. Punkt 1 ändrar därför inte vidden av de befogenheter som beviljas enligt artikel 19 och inte heller tolkningen av den artikeln.
      Punkt 2 motsvarar artikel 18 första stycket i fördraget om Europeiska unionens funktionssätt och bör tillämpas i enlighet med den artikeln.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

(5) Nothing contained in any law shall be held to be inconsistent with or in contravention of sub-article (1) of this article to the extent that it makes provision: (a) with respect to qualifications for service or conditions of service in any disciplined force; or (b) with respect to qualifications (not being qualifications specifically relating to sex) for service as a public officer or for service of a local government authority or a body corporate established for public purposes by any law. (6) Sub-article (2) of this article shall not apply to anything which is expressly or by necessary implication authorised to be done by any such provision of law as is referred to in sub-article (4) or (5) of this article. (7) Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this article to the extent that the law in question makes provision (not being provisions specifically relating to sex) whereby persons of any such description as is mentioned in sub-article (3) of this article may be subjected to any restriction on the rights and freedoms guaranteed by articles 38, 40, 41, 42 and 44 of this Constitution, being such a restriction as is authorised by article 38(2), 40(2), 41(2), 42(2) or 44(3). (8) Nothing in sub-article (2) of this article shall affect any discretion relating to the institution, conduct or discontinuance of civil or criminal proceedings in any court that is vested in any person by or under this Constitution or any other law. (9) A requirement, however made, that the Roman Catholic Apostolic Religion shall be taught by a person professing that religion shall not be held to be inconsistent with or in contravention of this article. (10) Until the expiration of a period of two years commencing on the lst July, 1991, nothing contained in any law made before the 1st July, 1991, shall be held to be inconsistent with the provisions of this article, in so far as that law provides for different treatment to different persons attributable wholly or mainly to their respective description by sex.
