Artikel 24 - De rechten van het kind

1. Kinderen hebben recht op de bescherming en de zorg die nodig zijn voor hun welzijn. Zij mogen vrijelijk hun mening uiten. Aan hun mening in hen betreffende aangelegenheden wordt in overeenstemming met hun leeftijd en rijpheid passend belang gehecht.
2. Bij alle handelingen in verband met kinderen, ongeacht of deze worden verricht door overheidsinstanties of particuliere instellingen, vormen de belangen van het kind een essentiële overweging.
3. Ieder kind heeft het recht, regelmatig persoonlijke betrekkingen en rechtstreekse contacten met zijn beide ouders te onderhouden, tenzij dit tegen zijn belangen indruist.

      Dit artikel is gebaseerd op het Verdrag van New York van 20 november 1989 inzake de rechten van het kind, dat door alle lidstaten is bekrachtigd, met name op de artikelen 3, 9, 12 en 13 van dat Verdrag.
      Lid 3 houdt rekening met het feit dat, als onderdeel van de totstandbrenging van een ruimte van vrijheid, veiligheid en rechtvaardigheid, de wetgeving van de Unie betreffende civiele zaken met grensoverschrijdende gevolgen, waarvoor artikel 81 van het Verdrag betreffende de werking van de Europese Unie bevoegdheid verleent, met name het bezoekrecht kan omvatten, zodat een kind regelmatig persoonlijke betrekkingen of rechtstreekse contacten met zijn beide ouders kan onderhouden.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.
