Artikolu 2 - Id-dritt għall-ħajja
1. Kull persuna għandha d-dritt għall-ħajja.
2. Ħadd m'għandu jiġi kkundannat għall-piena tal-mewt, jew titneħħielu ħajtu.
1. Il-paragrafu 1 ta' dan l-Artikolu hu bbażat fuq l-ewwel sentenza ta' l-Artikolu 2(1) tal-Konvenzjoni Ewropea dwar id-drittijiet tal-Bniedem (KEDB), li jgħid hekk: `1. Id-dritt għall-ħajja ta' kulħadd għandu jiġi protett b'liġi...`. 2. It-tieni sentenza ta' din id-dispożizzjoni, li tirreferi għall-piena tal-mewt, ġiet issuperata bid-dħul fis-seħħ ta' l-Artikolu 1 tal-Protokoll Nru. 6 tal-KEDB, li jgħid hekk: `Il-piena tal-mewt għandha tkun abolita. Ħadd ma għandu jiġi kkundannat għal dik il-piena jew titneħħilu ħajtu`.L-Artikolu 2(2) tal-Karta hu bbażat fuq dik id-dispożizzjoni. 3. Id-dispożizzjonijiet ta' l-Artikolu 2, tal-Karta jikkorrispondu għal dawk ta' l-Artikoli ta' hawn fuq tal-KEDB u tal-Protokoll tiegħu. Huma għandhom l-istess sens u l-istess ambitu skond l-Artikolu 52(3) tal-Karta. Għaldaqstant, id-definizzjonijiet `negattivi` li jidhru fil-KEDB għandhom jitqiesu wkoll bħala parti mill-Karta: a) l-Artikolu 2(2) tal-KEDB: `Il-privazzjoni tal-ħajja ma għandhiex titqies bħala magħmula bi ksur ta' dan l-Artikolu meta tirriżulta mill-użu ta' forza li ma jkunx aktar minn dak li jkun assolutament meħtieġ: a) fid-difiża ta' xi persuna minn vjolenza illegali; b) sabiex jiġi effettwat arrest skond il-liġi jew tiġi evitata l-ħarba ta' xi persuna detenuta skond il-liġi; ċ) f'azzjoni meħuda skond il-liġi sabiex tiġi megħluba rewwixta jew insurrezzjoni.` (b) l-Artikolu 2 tal-Protokoll Nru. 6 tal-KEDB: `Stat jista' jipprevedi fil-liġi tiegħu li jkun hemm il-piena mewt dwar dawk l-atti li jsiru fi żmien il-gwerra jew ta' theddida imminenti ta' gwerra; dik il-piena għandha tingħata biss fl-istanzi stipulati fil-liġi u skond id-dispożizzjonijiet relattivi…`.

Article 6 (1) Everyone has the right to life. Human life is worthy of protection even before birth. (2) Nobody may be deprived of her life. (3) The death penalty is prohibited. (4) Deprivation of life is not inflicted in contravention of this Article if it occurs in connection with conduct which is not criminal under the law.
Článek 6 (1) Každý má právo na život. Lidský život je hoden ochrany již před narozením. (2) Nikdo nesmí být zbaven života. (3) Trest smrti se nepřipouští. (4) Porušením práv podle tohoto článku není, jestliže byl někdo zbaven života v souvislosti s jednáním, které podle zákona není trestné.

No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.2. Artículo 15 Todos tienen derecho a la vida y a la integridad física y moral, sin que, en ningún caso, puedan ser sometidos a tortura ni a penas o tratos inhumanos o degradantes. Queda abolida la pena de muerte, salvo lo que puedan disponer las leyes penales militares para tiempos de guerra.
Article 15 Everyone has the right to life and to physical and moral integrity, and under no circumstances may be subjected to torture or to inhuman or degrading punishment or treatment. Death penalty is hereby abolished, except as provided for by military criminal law in times of war.
Article 17 Human life is inviolable. There is no capital punishment in Slovenia.
17. člen Človekovo življenje je nedotakljivo. V Sloveniji ni smrtne kazni.

(4) It is not violation of rights under this article, if someone is deprived of life as a result of an action that is not deemed criminal under the law.
Čl. 15(1) Každý má právo na život. Ľudský život je hodný ochrany už pred narodením. (2) Nikto nesmie byť pozbavený života. (3) Trest smrti sa nepripúšťa. (4) Podľa tohto článku nie je porušením práv, ak bol niekto pozbavený života v súvislosti s konaním, ktoré podľa zákona nie je trestné.

Article 331) No person shall intentionally be deprived of his life save in execution of the sentence of a court in respect of a criminal offence under the law of Malta of which he has been convicted.(2) Without prejudice to any liability for a contravention of any other law with respect to the use of force in such cases as are hereinafter mentioned, a person shall not be regarded as having been deprived of his life in contravention of this section if he dies as the result of the use of force to such extent as is reasonably justifiable in the circumstances of the case -- (a) for the defence of any person from violence or for the defence of property; (b) in order to effect a lawful arrest or to prevent the escape of a person lawfully detained; (c) for the purpose of suppressing a riot, insurrection or mutiny; or (d) in order to prevent the commission by that person of a criminal offence, or if he dies as the result of a lawful act of war.
