Artikel 12 - Versammlungs- und Vereinigungsfreiheit

  1. Jede Person hat das Recht, sich insbesondere im politischen, gewerkschaftlichen und zivilgesellschaftlichen Bereich auf allen Ebenen frei und friedlich mit anderen zu versammeln und frei mit anderen zusammenzuschließen, was das Recht jeder Person umfasst, zum Schutz ihrer Interessen Gewerkschaften zu gründen und Gewerkschaften beizutreten.
  2. Politische Parteien auf der Ebene der Union tragen dazu bei, den politischen Willen der Unionsbürgerinnen und Unionsbürger zum Ausdruck zu bringen.
    • Text:

      1. Absatz 1 dieses Artikels entspricht Artikel 11 EMRK, der wie folgt lautet:
        1. Jede Person hat das Recht, sich frei und friedlich mit anderen zu versammeln und sich frei mit anderen zusammenzuschließen; dazu gehört auch das Recht, zum Schutz seiner Interessen Gewerkschaften zu gründen und Gewerkschaften beizutreten.
        2. Die Ausübung dieser Rechte darf nur Einschränkungen unterworfen werden, die gesetzlich vorgesehen und in einer demokratischen Gesellschaft notwendig sind für die nationale oder öffentliche Sicherheit, zur Aufrechterhaltung der Ordnung oder zur Verhütung von Straftaten, zum Schutz der Gesundheit oder der Moral oder zum Schutz der Rechte und Freiheiten anderer. Dieser Artikel steht rechtmäßigen Einschränkungen der Ausübung dieser Rechte für Angehörige der Streitkräfte, der Polizei oder der Staatsverwaltung nicht entgegen.“ 

        Die Bestimmungen des Absatzes 1 dieses Artikels 12 haben die gleiche Bedeutung wie die Bestimmungen der EMRK; sie haben jedoch eine größere Tragweite, weil sie auf alle Ebenen, auch auf die europäische Ebene, Anwendung finden können. Nach Artikel 52 Absatz 3 der Charta dürfen die Einschränkungen dieses Rechts nicht über die Einschränkungen hinausgehen, die als mögliche rechtmäßige Einschränkungen im Sinne von Artikel 11 Absatz 2 EMRK gelten.

      2. Dieses Recht stützt sich auch auf Artikel 11 der Gemeinschaftscharta der sozialen Grundrechte der Arbeitnehmer.
      3. Absatz 2 dieses Artikels entspricht Artikel 10 Absatz 4 des Vertrags über die Europäische Union.

Everybody has the right to associate together with others in clubs, societies, and other associations. (2) Citizens also have the right to form political parties and political movements and to associate therein. (3) The exercise of these rights may be limited only in cases specified by law, if it involves measures that are necessary in a democratic society for the security of the state, the protection of public security and public order, the prevention of crime, or the protection of the rights and freedoms of others. (4) Political parties and political movements, as well as other associations, are separate from the state. Article 22 Any statutory provisions relating to political rights and freedoms, as well as the interpretation and application thereof, shall make possible and protect the free competition among political forces in a democratic society. Article 27 (1) Everyone has the right to associate freely with others for the protection of her economic and social interests. (2) Trade unions shall be established independently of the state. No limits may be placed upon the number of trade union organizations, nor may any of them be given preferential treatment in a particular enterprise or branch of industry. (3) The activities of trade unions and the formation and activities of similar associations for the protection of economic and social interests may be limited by law in the case of measures necessary in a democratic society for the protection of the security of the State, public order, or the rights and freedoms of others. (4) The right to strike is guaranteed under the conditions provided for by law; this right does not appertain to judges, prosecutors, or members of the armed forces or security corps.

      (1)Sections 132 to 138 of the Serious Organised Crime and Police Act 2005 (which regulate demonstrations and use of loudspeakers in the vicinity of Parliament) are repealed.
      (2)The public assemblies in relation to which section 14 of the Public Order Act 1986 applies, as a consequence of the repeal of section 132(6) of the Serious Organised Crime and Police Act 2005, include public assemblies which started, or were being organised, before this section comes into force.
      Controls on activities in Parliament Square Garden and adjoining pavements
      Section 142 Controlled area of Parliament Square
      (1)For the purposes of this Part, the “controlled area of Parliament Square” means the area of land that is comprised in—
      (a)the central garden of Parliament Square, and
      (b)the footways that immediately adjoin the central garden of Parliament Square.
      (2)In subsection (1)—
      “the central garden of Parliament Square” means the site in Parliament Square on which the Minister of Works was authorised by the Parliament Square (Improvements) Act 1949 to lay out the garden referred to in that Act as “the new central garden”;
      “footway” has the same meaning as in the Highways Act 1980 (see section 329(1) of that Act).
      143Prohibited activities in controlled area of Parliament Square
      (1)A constable or authorised officer who has reasonable grounds for believing that a person is doing, or is about to do, a prohibited activity may direct the person—
      (a)to cease doing that activity, or
      (b)(as the case may be) not to start doing that activity.
      (2)For the purposes of this Part, a “prohibited activity” is any of the following—
      (a)operating any amplified noise equipment in the controlled area of Parliament Square;
      (b)erecting or keeping erected in the controlled area of Parliament Square—
      (i)any tent, or
      (ii)any other structure that is designed, or adapted, (solely or mainly) for the purpose of facilitating sleeping or staying in a place for any period;
      (c)using any tent or other such structure in the controlled area of Parliament Square for the purpose of sleeping or staying in that area;
      (d)placing or keeping in place in the controlled area of Parliament Square any sleeping equipment with a view to its use (whether or not by the person placing it or keeping it in place) for the purpose of sleeping overnight in that area;
      (e)using any sleeping equipment in the controlled area of Parliament Square for the purpose of sleeping overnight in that area.
      (3)But an activity is not to be treated as a “prohibited activity” within subsection (2) if it is done—
      (a)for police, fire and rescue authority or ambulance purposes,
      (b)by or on behalf of a relevant authority, or
      (c)by a person so far as authorised under section 147 to do it (authorisation for operation of amplified noise equipment).
      (4)In subsection (2)(a) “amplified noise equipment” means any device that is designed or adapted for amplifying sound, including (but not limited to)—
      (a)loudspeakers, and
      (b)loudhailers.
      (5)In subsection (3)(b) “relevant authority” means any of the following—
      (a)a Minister of the Crown or a government department,
      (b)the Greater London Authority, or
      (c)Westminster City Council.
      (6)It is immaterial for the purposes of a prohibited activity—
      (a)in the case of an activity within subsection (2)(b) or (c) of keeping a tent or similar structure erected or using a tent or similar structure, whether the tent or structure was first erected before or after the coming into force of this section;
      (b)in the case of an activity within subsection (2)(d) or (e) of keeping in place any sleeping equipment or using any such equipment, whether the sleeping equipment was first placed before or after the coming into force of this section.
      (7)In this section “sleeping equipment” means any sleeping bag, mattress or other similar item designed, or adapted, (solely or mainly) for the purpose of facilitating sleeping in a place.
      (8)A person who fails without reasonable excuse to comply with a direction under subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding level 5 on the standard scale.

      Section 21 (1) The right to peaceful unarmed assembly is granted. The exercise of this right shall not require prior authorization. (2) In the case of meetings in public places and of demonstrations, prior notification shall be given to the authorities, who can only forbid them when there are well founded grounds to expect a breach of public order, involving danger to persons or property.

      Section 22 (1) The right of association is granted. (2) Associations which pursue ends or use means legally defined as criminal offences are illegal. (3) Associations set up on the basis of this section must be entered in a register for the sole purpose of public knowledge. (4) Associations may only be dissolved or have their activities suspended by virtue of a court order stating the reasons for it. (5) Secret and paramilitary associations are prohibited.

      Section 28 (1) All have the right to freely join a trade union. The law may restrict or except the exercise of this right in the Armed Forces or Institutes or other bodies subject to military discipline, and shall lay down the special conditions of its exercise by civil servants. Trade union freedom includes the right to set up trade unions and to join the union of one's choice, as well as the right of trade unions to form confederations and to found international trade union organizations, or to become members thereof. No one may be compelled to join a trade union. (2) The right of workers to strike in defence of their interests is recognized. The law governing the exercise of this right shall establish the safeguards necessary to ensure the maintenance of essential public services.

(3) The exercise of rights pursuant to paragraphs 1 and 2 may be restricted only in cases laid down by law if it is necessary in a democratic society for reasons of State security, to protect public order, to prevent criminal acts, or to protect the rights and freedoms of others. (4) Political parties and political movements, as well as clubs, societies or other associations separated from the State. Article 37(1) Everyone has the right to freely associate with others to protect their economic and social interests. (2) Trade unions are established independently of the State. It is inadmissible to limit the number of trade unions organizations, as well as to give some of them preferential status in an enterprise or a branch of the economy.(3) The activity of trade unions and the founding and operation of other associations protecting economic and social interests may be restricted by law, if such measure is necessary in a democratic society to protect the security of the State, public order, or the rights and freedoms of others. (4) The right to strike is guaranteed. The conditions shall be laid down by law. Judges, prosecutors, members of the armed forces and armed corps, and members and employees of Fire and Rescue Brigades do not have this right.

(3) Výkon práv podľa odsekov 1 a 2 možno obmedziť len v prípadoch ustanovených zákonom, ak je to v demokratickej spoločnosti nevyhnutné pre bezpečnosť štátu, na ochranu verejného poriadku, predchádzanie trestným činom alebo na ochranu práv a slobôd iných. (4) Politické strany a politické hnutia, ako aj spolky, spoločnosti alebo iné združenia sú oddelené od štátu.Čl. 3 7(1) Každý má právo sa slobodne združovať s inými na ochranu svojich hospodárskych a sociálnych záujmov. (2) Odborové organizácie vznikajú nezávisle od štátu. Obmedzovať počet odborových organizácií, ako aj zvýhodňovať niektoré z nich v podniku alebo v odvetví, je neprípustné. (3) Činnosť odborových organizácií a vznik a činnosť iných združení na ochranu hospodárskych a sociálnych záujmov možno obmedziť zákonom, ak ide o opatrenie v demokratickej spoločnosti nevyhnutné na ochranu bezpečnosti štátu, verejného poriadku alebo práv a slobôd druhých.(4) Právo na štrajk sa zaručuje. Podmienky ustanoví zákon. Toto právo nemajú sudcovia, prokurátori, príslušníci ozbrojených síl a ozbrojených zborov a príslušníci a zamestnanci hasičských a záchranných zborov.
