Artikel 1 - Würde des Menschen

Die Würde des Menschen ist unantastbar. Sie ist zu achten und zu schützen.

      Die Würde des Menschen ist nicht nur ein Grundrecht an sich, sondern bildet das eigentliche Fundament der Grundrechte. Die Allgemeine Erklärung der Menschenrechte von 1948 verankert die Menschenwürde in ihrer Präambel: „... da die Anerkennung der allen Mitgliedern der menschlichen Familie innewohnenden Würde und ihrer gleichen und unveräußerlichen Rechte die Grundlage der Freiheit, der Gerechtigkeit und des Friedens in der Welt bildet.“ In seinem Urteil vom 9. Oktober 2001 in der Rechtssache C-377/98, Niederlande gegen Europäisches Parlament und Rat, Slg. 2001, I-7079, Randnrn. 70-77 bestätigte der Gerichtshof, dass das Grundrecht auf Menschenwürde Teil des Unionsrechts ist.

      Daraus ergibt sich insbesondere, dass keines der in dieser Charta festgelegten Rechte dazu verwendet werden darf, die Würde eines anderen Menschen zu verletzen, und dass die Würde des Menschen zum Wesensgehalt der in dieser Charta festgelegten Rechte gehört. Sie darf daher auch bei Einschränkungen eines Rechtes nicht angetastet werden.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Die Erläuterungen wurden ursprünglich unter der Verantwortung des Präsidiums des Konvents, der die Charta der Grundrechte der Europäischen Union ausgearbeitet hat, formuliert. Sie wurden unter der Verantwortung des Präsidiums des Europäischen Konvents aufgrund der von diesem Konvent vorgenommenen Anpassungen des Wortlauts der Charta (insbesondere der Artikel 51 und 52) und der Fortentwicklung des Unionsrechts aktualisiert. Diese Erläuterungen haben als solche keinen rechtlichen Status, stellen jedoch eine nützliche Interpretationshilfe dar, die dazu dient, die Bestimmungen der Charta zu verdeutlichen.
