  1. Enhver har ret til ytringsfrihed. Denne ret omfatter meningsfrihed og frihed til at modtage eller meddele oplysninger eller tanker uden indblanding fra offentlig myndighed og uden hensyn til landegrænser.
  2. Mediefrihed og mediernes pluralisme respekteres.

      1. Artikel 11 svarer til artikel 10 i EMK, der har følgende ordlyd:
        »1. Enhver har ret til ytringsfrihed. Denne ret omfatter meningsfrihed og frihed til at modtage eller meddele oplysninger eller tanker, uden indblanding fra offentlig myndighed og uden hensyn til landegrænser. Denne artikel forhindrer ikke stater i at kræve, at radio-, fjernsyns- eller filmforetagender kun må drives i henhold til bevilling.
        2. Da udøvelsen af disse frihedsrettigheder medfører pligter og ansvar, kan den underkastes sådanne formaliteter, betingelser, restriktioner eller straffebestemmelser, som er foreskrevet ved lov og er nødvendige i et demokratisk samfund af hensyn til den nationale sikkerhed, territorial integritet eller offentlig tryghed, for at forebygge uorden eller forbrydelse, for at beskytte sundheden eller sædeligheden, for at beskytte andres gode navn og rygte eller rettigheder, for at forhindre udspredelse af fortrolige oplysninger, eller for at sikre domsmagtens autoritet og upartiskhed.« 

        I henhold til artikel 52, stk. 3, har denne ret samme betydning og omfang som den ret, der er sikret ved EMK. De begrænsninger, der kan foretages i denne ret, må altså ikke være mere omfattende end dem, der er fastsat i artikel 10, stk. 2, jf. dog de begrænsninger, som EU's konkurrenceret kan lægge på medlemsstaternes ret til at indføre bevillingsordninger, som omhandlet i artikel 10, stk. 1, tredje punktum, i EMK.

      2. Denne artikels stk. 2 ekspliciterer følgerne af stk. 1 for så vidt angår mediefrihed. Disse følger bygger på Domstolens retspraksis vedrørende fjernsyn, navnlig dom af 25. juli 1991, sag C-288/89, Stichting Collectieve Antennevoorziening Gouda m.fl., Sml. I, s. 4007) og på protokollen om offentlig radio- og tv-virksomhed i medlemsstaterne knyttet til EF-traktaten og nu til traktaterne samt på Rådets direktiv 89/552/EØF (jf. navnlig betragtning nr. 17).

      Disse forklaringer blev oprindelig udarbejdet under præsidiet for den forsamling, der udarbejdede chartret om grundlæggende rettigheder. De er blevet ajourført under Det Europæiske Konvents præsidiums ansvar i lyset af de udkast til tilpasninger, som konventet har foretaget i charterteksten (især i artikel 51 og 52) og videreudviklingen af EU-retten. Selv om forklaringerne ikke i sig selv har retskraft, udgør de et værdifuldt fortolkningsinstrument beregnet til nærmere præcisering af chartrets bestemmelser.

      Article 38
      Freedom of thought and expression shall be guaranteed.
      Freedom of expression shall particularly encompass freedom of the press and other media, freedom of speech and public opinion, and free establishment of all institutions of public communication.
      Censorship shall be forbidden. Journalists shall have the right to freedom of reporting and access to information.
      The right to access to information held by any public authority shall be guaranteed.
      Restrictions on the right to access to information must be proportionate to the nature of the need for such restriction in each individual case and necessary in a free and democratic society, as stipulated by law.
      The right to correction is guaranteed to anyone whose constitutionally and legally established rights have been violated by public communication.

      Jamči se sloboda mišljenja i izražavanja misli.
      Sloboda izražavanja misli obuhvaća osobito slobodu tiska i drugih sredstava priopćavanja, slobodu govora i javnog nastupa i slobodno osnivanje svih ustanova javnog priopćavanja.
      Zabranjuje se cenzura. Novinari imaju pravo na slobodu izvještavanja i pristupa informaciji.
      Jamči se pravo na pristup informacijama koje posjeduju tijela javne vlasti. Ograničenja prava na pristup informacijama moraju biti razmjerna naravi potrebe za ograničenjem u svakom pojedinom slučaju te nužna u slobodnom i demokratskom društvu, a propisuju se zakonom.
      Jamči se pravo na ispravak svakomu komu je javnom viješću povrijeđeno Ustavom i zakonom utvrđeno pravo.

(1) The press and the other mass information media shall be free and shall not be subjected to censorship. (2) An injunction on or a confiscation of printed matter or another information medium shall be allowed only through an act of the judicial authorities in the case of an encroachment on public decency or incitement of a forcible change of the constitutionally established order, the perpetration of a crime, or the incitement of violence against anyone. An injunction suspension shall lose force if not followed by a confiscation within 24 hours.Art. 41. (1) Everyone shall be entitled to seek, obtain and disseminate information. Die volle Vereins- und Versammlungsfreiheit ohne Unterschied des Geschlechts ist hergestellt.
