Artikel 34 - Social trygghet och socialt stöd

1. Unionen erkänner och respekterar rätten till tillgång till social trygghet och sociala förmåner som garanterar skydd i sådana fall som moderskap, sjukdom, olyckor i arbetet, omsorgsbehov eller ålderdom samt vid arbetslöshet i enlighet med närmare bestämmelser i unionsrätten samt nationell lagstiftning och praxis.
2. Var och en som är bosatt och förflyttar sig lagligt inom unionen har rätt till social trygghet och sociala förmåner i enlighet med unionsrätten samt nationell lagstiftning och praxis.
3. I syfte att bekämpa social utestängning och fattigdom ska unionen erkänna och respektera rätten till socialt stöd och till stöd till boendet som, i enlighet med närmare bestämmelser i unionsrätten samt i nationell lagstiftning och praxis, är avsedda att trygga en värdig tillvaro för alla dem som saknar tillräckliga medel.

      Principen i artikel 34.1 grundas på artiklarna 153 och 156 i fördraget om Europeiska unionens funktionssätt samt på artikel 12 i europeiska sociala stadgan och punkt 10 i gemenskapsstadgan om arbetstagares rättigheter. Den måste respekteras av unionen när denna utövar de befogenheter som den erhållit enligt artiklarna 153 och 156 i fördraget om Europeiska unionens funktionssätt. Hänvisningen till socialtjänst avser de fall då en sådan tjänst har inrättats för att tillhandahålla vissa förmåner men innebär inte alls att en sådan tjänst måste inrättas om den inte redan finns. Begreppet moderskap ska tolkas på samma sätt som i föregående artikel.
      Punkt 2 grundas på artiklarna 12.4 och 13.4 i europeiska sociala stadgan och punkt 2 i gemenskapsstadgan om arbetstagares grundläggande sociala rättigheter och återspeglar de regler som härrör från förordning (EEG) nr 1408/71 och förordning (EEG) nr 1612/68.

      I punkt 3 har inspiration hämtats från artikel 13 i europeiska sociala stadgan och artiklarna 30 och 31 i den reviderade sociala stadgan och punkt 10 i gemenskapsstadgan. Den måste respekteras av unionen i samband med politik som grundas på artikel 153 i fördraget om Europeiska unionens funktionssätt.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

Anyaság, betegség, rokkantság, fogyatékosság, özvegység, árvaság és önhibáján kívül bekövetkezett munkanélküliség esetén minden magyar állampolgár törvényben meghatározott támogatásra jogosult.
      (2) Magyarország a szociális biztonságot az (1) bekezdés szerinti és más rászorulók esetében a szociális intézmények és intézkedések rendszerével valósítja meg.
      (3) Törvény a szociális intézkedések jellegét és mértékét a szociális intézkedést igénybe vevő személynek a közösség számára hasznos tevékenységéhez igazodóan is megállapíthatja.
      (4) Magyarország az időskori megélhetés biztosítását a társadalmi szolidaritáson alapuló egységes állami nyugdíjrendszer fenntartásával és önkéntesen létrehozott társadalmi intézmények működésének lehetővé tételével segíti elő. Törvény az állami nyugdíjra való jogosultság feltételeit a nők fokozott védelmének követelményére tekintettel is megállapíthatja.

      XXII. cikk (SZABADSÁG ÉS FELELŐSSÉG) (1) Magyarország törekszik arra, hogy az emberhez méltó lakhatás feltételeit és a közszolgáltatásokhoz való hozzáférést mindenki számára biztosítsa.
      (2) Az emberhez méltó lakhatás feltételeinek a megteremtését az állam és a helyi önkormányzatok azzal is segítik, hogy törekszenek valamennyi hajlék nélkül élő személy számára szállást biztosítani.
      (3) Törvény vagy helyi önkormányzat rendelete a közrend, a közbiztonság, a közegészség és a kulturális értékek védelme érdekében, a közterület meghatározott részére vonatkozóan jogellenessé minősítheti az életvitelszerűen megvalósuló közterületi tartózkodást.

Every Hungarian citizen shall be entitled to assistance in the case of maternity, illness, invalidity, disability, widowhood, orphanage and unemployment for reasons outside of his or her control, as provided for by an Act.
      (2) Hungary shall implement social security for the persons referred to in Paragraph (1) and for others in need through a system of social institutions and measures.
      (3) The nature and extent of social measures may be determined in an Act in accordance with the usefulness to the community of the beneficiary’s activity.
      (4) Hungary shall contribute to ensuring a life of dignity for the elderly by maintaining a
      general state pension system based on social solidarity and by allowing for the operation of voluntarily established social institutions. An Act may lay down the conditions for entitlement to state pension also with regard to the requirement for stronger protection for women.

      Article XXII (Freedom and Responsibility) (1) Hungary shall strive to ensure decent housing conditions and access to public services for everyone.
      (2) The State and local governments shall also contribute to creating decent housing conditions by striving to ensure accommodation for all persons without a dwelling.
      (3) In order to protect public order, public safety, public health and cultural artefacts, an Act or a local government decree may, with respect to a specific part of public space, provide that using a public space as a habitual dwelling shall be illegal.
