21. pants - Diskriminācijas aizliegums

1. Aizliegta jebkāda veida diskriminācija, tostarp diskriminācija dzimuma, rases, ādas krāsas, etniskās vai sociālās izcelsmes, ģenētisko īpatnību, valodas, reliģijas vai pārliecības, politisko vai jebkuru citu uzskatu dēļ, diskriminācija saistībā ar piederību pie nacionālās minoritātes, diskriminācija īpašuma, izcelsmes, invaliditātes, vecuma vai dzimumorientācijas dēļ.
2. Ievērojot Līgumu piemērošanas jomu un neskarot tajos paredzētos īpašos noteikumus, ir aizliegta jebkāda diskriminācija pilsonības dēļ.

    • Text:

      Panta 1. punkta pamatā ir EK līguma 13. pants, kas tagad aizstāts ar Līguma par Eiropas Savienības darbību 19. pantu, un ECK 14. pants un Cilvēktiesību un biomedicīnas konvencijas 11. pants attiecībā uz ģenētisko mantojumu. Ciktāl tas atbilst ECK 14. pantam, to piemēro saskaņā ar minēto pantu.
      Starp 1. punktu un Līguma par Eiropas Savienības darbību 19. pantu, kam ir cita darbības joma un mērķis, nav pretrunas vai nesaderības: 19. pants Savienībai dod tiesības pieņemt tiesību aktus, tostarp saskaņot dalībvalstu normatīvos un administratīvos aktus, lai novērstu konkrētas diskriminācijas izpausmes, kas pilnībā uzskaitītas minētajā pantā. Tādi tiesību akti var attiekties uz dalībvalstu iestāžu darbību (tāpat uz privātpersonu attiecībām) jebkurā jomā, uz kuru attiecas Savienības kompetences. Savukārt 21. panta 1. punktā neparedz kompetenci ieviest tiesību aktus attiecībā uz diskriminācijas apkarošanu šajās dalībvalstu vai privātpersonu darbības jomās, nedz arī paredz pilnīgu diskriminācijas aizliegumu šajās jomās. Tas tikai vēršas pret diskrimināciju, ko veic pašas Savienības iestādes un struktūras, lai īstenotu kompetences, kas tām uzticētas ar Līgumiem, un ko veic dalībvalstis, ieviešot Savienības tiesību aktus. Tātad 1. punkts nemaina ar 19. pantu piešķirtās kompetences apjomu, nedz arī panta interpretāciju.
      Panta 2. punkts atbilst Līguma par Eiropas Savienības darbību 18. panta pirmajai daļai un jāpiemēro saskaņā ar to.

Tie ir atjaunināti Eiropas Konventa prezidija vadībā, ņemot vērā Konventa izdarītos Hartas teksta (jo īpaši 51. un 52. panta) precizējumus un Savienības tiesību turpmāku attīstību. Kaut arī šiem paskaidrojumiem nav juridiska spēka, tie ir vērtīgi interpretācijas līdzekļi, kas paredzēti Hartas noteikumu izskaidrošanai.
