    Key facts of the case:
     
    According to Portuguese legislation, access to the liberal profession of notaries was restricted in a way the Commission assessed as being contrary to provisions of Directive 2005/36; therefore, Portugal was charged before CJ of failure of transposition of the said Directive (though “the letters of formal notice and the reasoned opinion issued by the Commission related to Directive 89/48” [judgement, para 39]).
