Key facts of the case:
In this case a local township challenged the decision of the Romanian national equality body, the National Council for Combating Discrimination (Consiliul Național pentru Combaterea Discriminării, CNCD) to sanction it for a decision to forcefully resettle Roma. The Roma community were living in that city without access to electricity or other utilities. They asked the mayor to remedy the situation and the mayor responded by forcefully relocating them in a nearby village. Because of this, the Romanian CNCD fined the mayor with 5 000 RON.
Outcome of the case:
The Court ruled that the decision of the mayor to forcefully resettle the Roma community was discriminatory. The court found that the mayor indirectly discriminated the Roma community infringing on their rights to equality, dignity and their right to freely choose their residence.
The EU Charter of Fundamental Rights also reaffirms the rights stemming mainly from the constitutional traditions and international obligations common to the Member States, the ECHR, the Social Charters adopted by the EU and the CoE, and in the context of the CJEU jurisprudence, the need to respect human dignity must be protected, the prohibition of discrimination of any kind, based on race, color, ethnic or social origin, genetic characteristics, language, religion or beliefs, belonging to a national minority according to art. 20 of the Charter, as the Union respects cultural, religious and linguistic diversity.
De asemenea, Carta Drepturilor Fundamentale ale UE, reafirma drepturile care rezulta in principal din traditiile constitutionale si din obligatiile internationale comune statelor membre, din CEDO, Cartele sociale adoptate de UE si CE, cat si in contextul jurisprudentei CJUE, necesitatea respectarii demnitatii umane, care trebuie protejata, interzicerea discriminarii de orice fel, bazata pe motive de rasa, culoare, origine etnica sau sociala, caracteristici genetice, limba, religia sau convingeri, apartenenta la o minoritate nationala potrivit art. 20 din Carta, în conditiile în care Uniunea respecta diversitatea culturala, religioasa și lingvistica.
