Άρθρο 8 - Προστασία των δεδομένων προσωπικού χαρακτήρα

1. Κάθε πρόσωπο έχει δικαίωμα στην προστασία των δεδομένων προσωπικού χαρακτήρα που το αφορούν.

2. Η επεξεργασία αυτών των δεδομένων πρέπει να γίνεται νομίμως, για καθορισμένους σκοπούς και με βάση τη συγκατάθεση του ενδιαφερομένου ή για άλλους θεμιτούς λόγους που προβλέπονται από το νόμο. Κάθε πρόσωπο δικαιούται να έχει πρόσβαση στα συλλεγέντα δεδομένα που το αφορούν και να επιτυγχάνει τη διόρθωσή τους.

3. Ο σεβασμός των κανόνων αυτών υπόκειται στον έλεγχο ανεξάρτητης αρχής.

      Το παρόν άρθρο βασίστηκε στο άρθρο 286 της Συνθήκης περί ιδρύσεως της Ευρωπαϊκής Κοινότητας και στην οδηγία 95/46/ΕΚ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου σχετικά με την προστασία των φυσικών προσώπων έναντι της επεξεργασίας των δεδομένων προσωπικού χαρακτήρα και με την ελεύθερη κυκλοφορία των δεδομένων αυτών (ΕΕ L 281, 23.11.1995, σ. 31), καθώς και στο άρθρο 8 της ΕΣΑΔ και στη Σύμβαση του Συμβουλίου της Ευρώπης για την προστασία των προσώπων έναντι της αυτοματοποιημένης επεξεργασίας των δεδομένων προσωπικού χαρακτήρα της 28ης Ιανουαρίου 1981, η οποία έχει κυρωθεί από όλα τα κράτη μέλη. Το άρθρο 286 της Συνθήκης ΕΚ έχει πλέον αντικατασταθεί από το άρθρο 16 της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης και το άρθρο 39 της Συνθήκης για την Ευρωπαϊκή Ένωση. Θα πρέπει επίσης να αναφερθεί ο κανονισμός (ΕΚ) αριθ. 45/2001 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου σχετικά με την προστασία των φυσικών προσώπων έναντι της επεξεργασίας δεδομένων προσωπικού χαρακτήρα από τα όργανα και τους οργανισμούς της Κοινότητας και σχετικά με την ελεύθερη κυκλοφορία των δεδομένων αυτών (ΕΕ L 8, 12.1.2001, σ. 1). Η προαναφερόμενη οδηγία και ο εν λόγω κανονισμός περιέχουν όρους και περιορισμούς σχετικά με την άσκηση του δικαιώματος προστασίας των δεδομένων προσωπικού χαρακτήρα.

      Οι κάτωθι παρατιθέμενες επεξηγήσεις καταρτίσθηκαν αρχικά υπ’ ευθύνη του Προεδρείου της Συνέλευσης που συνέταξε τον Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης. Ενημερώθηκαν με ευθύνη του Προεδρείου της Ευρωπαϊκής Συνέλευσης, κατόπιν των αναπροσαρμογών που επήλθαν στο κείμενο του Χάρτη από τη Συνέλευση αυτή (ιδίως στα άρθρα 51 και 52) και των εξελίξεων του δικαίου της Ένωσης. Αν και οι επεξηγήσεις αυτές καθαυτές δεν έχουν νομική ισχύ, αποτελούν πολύτιμο εργαλείο ερμηνείας για την εξήγηση των διατάξεων του Χάρτη.

A informática não pode ser utilizada para tratamento de dados referentes a convicções filosóficas ou políticas, filiação partidária ou sindical, fé religiosa, vida privada e origem étnica, salvo mediante consentimento expresso do titular, autorização prevista por lei com garantias de não discriminação ou para processamento de dados estatísticos não individualmente identificáveis. 4. É proibido o acesso a dados pessoais de terceiros, salvo em casos excepcionais previstos na lei. 5. É proibida a atribuição de um número nacional único aos cidadãos. 6. A todos é garantido livre acesso às redes informáticas de uso público, definindo a lei o regime aplicável aos fluxos de dados transfronteiras e as formas adequadas de protecção de dados pessoais e de outros cuja salvaguarda se justifique por razões de interesse nacional. 7. Os dados pessoais constantes de ficheiros manuais gozam de protecção idêntica à prevista nos números anteriores, nos termos da lei.

      Article 35 (Use of information technology) (1) All citizens have the right of access to any computerised data relating to them and the right to be informed of the use for which the data is intended, under the law; they are entitled to require that the contents of the files and records be corrected and brought up to date.(2) The law shall determine what is personal data as well as the conditions applicable to automatic processing, connection, transmission and use thereof, and shall guarantee its protection by means of an independent administrative body. (3) Computerised storage shall not be used for information concerning a person's ideological or political convictions, party or trade union affiliations, religious beliefs, private life or ethnic origin, except where there is express consent from the data subject, authorisation provided for under the law with guarantees of non-discrimination or, in the case of data, for statistical purposes, that does not identify individuals. (4) Access to personal data of third parties is prohibited, except in exceptional cases as prescribed by law. (5) Citizens shall not be given an all-purpose national identity number. (6) Everyone shall be guaranteed free access to public information networks and the law shall define the regulations applicable to the transnational data flows and the adequate norms of protection for personal data and for data that should be safeguarded in the national interest. (7) Personal data kept on manual files shall benefit from protection identical to that provided for in the above Articles, in accordance with the law.
