Никой не може да бъде подложен на изтезания, на нечовешко или унизително отношение или наказание.

      Посоченото в член 4 право съответства на правото, гарантирано в член 3 от ЕКПЧ, чийто текст е идентичен: „Никой не може да бъде подложен на изтезания или нечовешко или унизително отнасяне или наказание.“ По силата на член 52, параграф 3 от Хартата, то има следователно същия смисъл и същия обхват, както посочения член от ЕКПЧ.

      Preamble - Explanations relating to the Charter of Fundamental Rights:
      Дадените по-долу разяснения бяха подготвени първоначално под ръководството на президиума на Конвента, който изработи Хартата на основните права на Европейския съюз. Те бяха актуализирани под ръководството на президиума на Европейския конвент в светлината на внесените от този Конвент изменения в текста на Хартата (по-специално в членове 51 и 52), както и на развитието на правото на Съюза. Въпреки че тези разяснения сами по себе си нямат юридическа сила, те представляват ценно средство за тълкуване, което е предназначено да изясни разпоредбите на Хартата.

      Article 417bis (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). For the purpose of this section, the following definitions are used:
      1° Torture : every intentional inhuman treatment that causes agonising pain or serious and terrible physical or mental suffering;
      2° Inhuman treatment : every treatment that will cause a person severe intentional physical or mental pain with the aim to receive intelligence, confessions, punish, exert pressure on that person or on a third party, or to intimidate him or a third party ;
      3° Degrading treatment : every treatment that in the eyes of the victim or of a third party, a serious injury or impairment to the human dignity. Article 417ter (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). He who subjects a person to torture, will be punished with a confinement of ten to fifteen year. (...). Article 417quater (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). He who subjects a person to inhuman treatment, will be punished with a confinement of ten to fifteen year. (...). Article 417quinquies (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). He who subjects a person to degrading treatment, will be punished with a sentence of fifteen days to five year or with a fine of 50 EUR to 300 EUR or with one of these punishments individually.
