1. Tá ag gach duine an ceart chun saoirse comhthionóil shíochánta agus chun saoirse comhlachais ar gach leibhéal, go háirithe in ábhair pholaitiúla, ceardchumainn agus sibhialta, rud a thugann le tuiscint go bhfuil ag gach duine an ceart chun ceardchumainn a chur ar bun agus an ceart chun bheith mar bhall de cheardchumainn chun a leasanna a chosaint.

2. Rannchuidíonn na páirtithe polaitiúla ar leibhéal Aontais chun toil pholaitiúil shaoránaigh an Aontais a chur in iúl.

      1. Freagraíonn mír 1 den Airteagal seo d'Airteagal 11 den CECD ar mar seo a leanas atá:
      `1. Tá ag gach uile dhuine an ceart chun saoirse a bheith aige teacht ar tionól agus gabháil le comhlachas go sítheoilte, lena n-áirítear an ceart chun ceardchumainn a bhunú agus gabháil le ceardchumainn chun a leasa a chosaint.
      2. Ní chuirfear aon srian le feidhmiú na gceart sin seachas pé srian a bheas ordaithe le dlí agus is gá i ndaonlathas ar mhaithe leis an tslándáil náisiúnta nó le sábháilteacht an phobail, nó chun anord nó coiriúlacht a chosc, nó chun an tsláinte nó an mhoráltacht a chosaint nó chun cearta agus saoirsí daoine eile a chosaint. Ní choiscfidh an tAirteagal seo srianta dleathacha a chur ar fheidhmiú na gceart sin ag comhaltaí de na fórsaí armtha, de na póilíní, nó de lucht riaracháin an Stáit.`
      Is ionann an bhrí atá le forálacha mhír 1 den Airteagal seo 12 agus an bhrí atá leis an CECD ach is forleithne a raon feidhme toisc go bhfuil feidhm acu ar gach uile leibhéal, lena n-áirítear an leibhéal Eorpach. I gcomhréir le hAirteagal 52(3) den Chairt, ní fhéadfar níos mó de theorainneacha a chur leis an gceart sin ná na teorainneacha a mheastar a bheith dlisteanach de bhua Airteagal 11(2) den CECD.
      2. Tá an ceart seo bunaithe freisin ar Airteagal 11 den Chairt Chomhphobail um Chearta Sóisialta Bunúsacha le haghaidh Oibrithe.
      3. Freagraíonn mír 2 den Airteagal seo d'Airteagal 10(4) den Chonradh ar an Aontas Eorpach.

(2) Associations shall pursue their purposes freely and without interference from the public authorities, and may not be dissolved by the state or have their activities suspended other than in cases provided for by law and then only by judicial decision. (3) No one may be obliged to belong to an association, or be coerced to remain therein by any means. The freedom of association shall be guaranteed to everyone. 2. Associations whose purposes or activities are contrary to the Constitution or statutes shall be prohibited. The courts shall adjudicate whether to permit an association to register or to prohibit an association from such activities. 3. Statutes shall specify types of associations requiring court registration, a procedure for such registration and the forms of supervision of such associations.Article 59 1. The freedom of association in trade unions, socio-occupational organizations of farmers, and in employers' organizations shall be ensured. 2. Trade unions and employers and their organizations shall have the right to bargain, particularly for the purpose of resolving collective disputes, and to conclude collective labour agreements and other arrangements. 3. Trade unions shall have the right to organize workers' strikes or other forms of protest subject to limitations specified by statute. For protection of the public interest, statutes may limit or forbid the conduct of strikes by specified categories of employees or in specific fields. 4. The scope of freedom of association in trade unions and in employers' organizations may only be subject to such statutory limitations as are permissible in accordance with international agreements to which the Republic of Poland is a party.

Związki zawodowe oraz pracodawcy i ich organizacje mają prawo do rokowań, w szczególności w celu rozwiązywania sporów zbiorowych, oraz do zawierania układów zbiorowych pracy i innych porozumień. 3. Związkom zawodowym przysługuje prawo do organizowania strajków pracowniczych i innych form protestu w granicach określonych w ustawie. Ze względu na dobro publiczne ustawa może ograniczyć prowadzenie strajku lub zakazać go w odniesieniu do określonych kategorii pracowników lub w określonych dziedzinach. 4. Zakres wolności zrzeszania się w związkach zawodowych i organizacjach pracodawców oraz innych wolności związkowych może podlegać tylko takim ograniczeniom ustawowym, jakie są dopuszczalne przez wiążące Rzeczpospolitą Polską umowy międzynarodowe.

(2) Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this article to the extent that the law in question makes provision – (a) that is reasonably required - (i) in the interests of defence, public safety, public order, public morality or decency, or public health; or (ii) for the purpose of protecting the rights or freedoms of other persons; or (b) that imposes restrictions upon public officers, and except so far as that provision or, as the case may be, the thing done under the authority thereof is shown not to be reasonably justifiable in a democratic society. (3) For the purposes of this article, any provision in any law prohibiting the holding of public meetings or demonstrations in any one or more particular cities, towns, suburbs or villages shall be held to be a provision which is not reasonably justifiable in a democratic society.

An association may not be dissolved for violation of the law or of a substantial provision of its statutes, except by court judgment. (3). The provisions of the preceding paragraph shall apply, as the case may be, to unions of persons not constituting an association. (4). Agricultural and urban cooperatives of all types shall be self-governed according to the provisions of the law and of their statutes; they shall be under the protection and supervision of the State which is obliged to provide for their development. (5). Establishment by law of compulsory cooperatives serving purposes of common benefit or public interest or common exploitation of farming areas or other wealth producing sources shall be permitted, on condition however that the equal treatment of all participants shall be assured.

Sie erfüllen mit ihrer freien, dauernden Mitwirkung an der politischen Willensbildung des Volkes eine ihnen nach dem Grundgesetz obliegende und von ihm verbürgte öffentliche Aufgabe.(2) Die Parteien wirken an der Bildung des politischen Willens des Volkes auf allen Gebieten des öffentlichen Lebens mit, indem sie insbesondere auf die Gestaltung der öffentlichen Meinung Einfluss nehmen, die politische Bildung anregen und vertiefen, die aktive Teilnahme der Bürger am politischen Leben fördern, zur Übernahme öffentlicher Verantwortung befähigte Bürger heranbilden, sich durch Aufstellung von Bewerbern an den Wahlen in Bund, Ländern und Gemeinden beteiligen, auf die politische Entwicklung in Parlament und Regierung Einfluss nehmen, die von ihnen erarbeiteten politi-schen Ziele in den Prozess der staatlichen Willensbildung einführen und für eine ständige lebendige Verbindung zwi-schen dem Volk und den Staatsorganen sorgen.(3) Die Parteien legen ihre Ziele in politischen Programmen nieder.(4) Die Parteien verwenden ihre Mittel ausschließlich für die ihnen nach dem Grundgesetz und diesem Gesetz obliegenden Aufgaben.

(3) Das Recht, zur Wahrung und Förderung der Arbeits- und Wirtschaftsbedingungen Vereinigungen zu bilden, ist für jedermann und für alle Berufe gewährleistet. Abreden, die dieses Recht einschränken oder zu behindern suchen, sind nichtig, hierauf gerichtete Maßnahmen sind rechtswidrig. Maßnahmen nach den Artikeln 12a, 35 Abs. 2 und 3, Artikel 87a Abs. 4 und Artikel 91 dürfen sich nicht gegen Arbeitskämpfe richten, die zur Wahrung und Förderung der Arbeits- und Wirtschaftsbedingungen von Vereinigungen im Sinne des Satzes 1 geführt werden. Artikel 17a (1) Gesetze über Wehrdienst und Ersatzdienst können bestimmen, daß für die Angehörigen der Streitkräfte und des Ersatzdienstes während der Zeit des Wehr- oder Ersatzdienstes das Grundrecht, seine Meinung in Wort, Schrift und Bild frei zu äußern und zu verbreiten (Artikel 5 Abs. 1 Satz 1 erster Halbsatz), das Grundrecht der Versammlungsfreiheit (Artikel 8) und das Petitionsrecht (Artikel 17), soweit es das Recht gewährt, Bitten oder Beschwerden in Gemeinschaft mit anderen vorzubringen, eingeschränkt werden. (...) Artikel 21 (1) Die Parteien wirken bei der politischen Willensbildung des Volkes mit. Ihre Gründung ist frei. Ihre innere Ordnung muß demokratischen Grundsätzen entsprechen. Sie müssen über die Herkunft und Verwendung ihrer Mittel sowie über ihr Vermögen öffentlich Rechenschaft geben. (2) Parteien, die nach ihren Zielen oder nach dem Verhalten ihrer Anhänger darauf ausgehen, die freiheitliche demokratische Grundordnung zu beeinträchtigen oder zu beseitigen oder den Bestand der Bundesrepublik Deutschland zu gefährden, sind verfassungswidrig. Über die Frage der Verfassungswidrigkeit entscheidet das Bundesverfassungsgericht. (3) Das Nähere regeln Bundesgesetze.

      Article 1 General provisions(1) Political parties are a component of the free democratic basic order required under the Constitution. Due to their free and continuous participation in the formation of the political will of the people, they perform a public function which is incumbent on them under the Basic Law and which they undertake to fulfil to the best of their ability. (2) The parties shall participate in the formation of the political will of the people in all fields of public life, in particular by exerting influence on the shaping of public opinion; inspiring and furthering political education; promoting active public participation in political life; training capable people to assume public responsibilities; participating in federal, Land and local government elections by nominating candidates; exerting influence on political developments in parliament and government; incorporating their defined political aims into the national decision-making process; and ensuring continuous, vital links between the people and the instruments of state. (3) The parties shall lay down their aims in political programs. (4) The parties shall use their funds solely for performing the functions incumbent on them under the Basic Law and this law.
