Artikkel 30 - Kaitse põhjendamatu vallandamise korral
Igal töötajal on õigus kaitsele põhjendamatu vallandamise eest liidu õiguse ning siseriiklike õigusaktide ja tavade kohaselt.
Käesolev artikkel toetub täiendatud ja parandatud sotsiaalharta artiklile 24. Vaata samuti direktiivi 2001/23/EÜ töötajate õiguste kaitsmise kohta ettevõtjate, ettevõtete või nende osade üleminekul, ning direktiivi 80/987/EMÜ töötajate kaitsmise kohta tööandja maksejõuetuse korral, mida on muudetud direktiiviga 2002/74/EÜ.

Article 53 (Job security) The right of workers to security of employment is guaranteed. Dismissals without just cause or for political or ideological reasons are prohibited.

In the case of Re Hagughey [1971] I.R. 217, the Chief Justice of the Supreme Court stated: '… in proceedings before any tribunal (this Courts emphasis) where a party to the proceedings is on risk of having his good name, or his person or property, or any of his personal rights jeopardized, the proceedings may be correctly classed as proceedings which may affect his rights, and in compliance with the Constitution the State, either by its enactments or through the courts, must outlaw any procedures which will restrict or prevent the party concerned from vindicating these rights.'

Chapter XVI - Termination of Employment Relationship deals with protection from dismissal.
7. Information about employment conditions and protection in case of dismissals Workers have the right to be informed in writing at the start of employment about their rights and obligations resulting from the employment relationship, including on probation period. Prior to any dismissal, workers have the right to be informed of the reasons and be granted a reasonable period of notice. They have the right to access to effective and impartial dispute resolution and, in case of unjustified dismissal, a right to redress, including adequate compensation.
